california women, each have the same first and last initials in the mid 70s and mid-90s, he's acting as his own attorney telling the judge he only needs four weeks but the trial set for march 28th ooj one-time hell's angel member captured saturday after a four-month long search was alined -- arraigned today. he is accused of shooting another hell's angel at a funeral. >> this 39-year-old steven ruiz brought into the courtroom but there is no evidence of hell's inangels inside or outside of the courtroom. ruiz being charged with a count of homicide in the october 15th death of another hem's angel member at oak hill cemetery, both there for the death of the san jose hell's angels chapter president. defense attorney told reporters after the arraignment he will be filing a request for a gag order.

gas prices continue to climb the national average up 45 cents since the first of the year. it's selling for 4.37s ndz san francisco. and gas consumption down in cal but we're exporting a lot of it. we're live now with more on that. laura? >> well, california refiners will tell you that that drop in consumption is what drives them to find markets else wr. and they will say that their exports have nothing to do with price paid here at the pump. while californians pay near record prices, california refineries are shipping tens of thousands of barrels of gasoline out of the state. and out of the country. every day. >> this are things they do there, they ought to keep it here, not sell it and drive prices up.

>> according to california energy commission, last year the refineries produced a million gallons per day. of that, 110,000 was exported to other states and countries. that as prices here continue to skyrocket. >> there isn't a connection between export of fuels in and out of the market or united states and the price gasoline right now. that is and has to do with cost of crude oil. >> 67% goes to pechl mechl. 25% canada. 5% ecuador. 92% of the california gas headed to other states goes to oregon. price of a gallon is 40 cents cheaper than here. >> if they kept and forced to keep all of their products in the state... in the very short

we want to start updating you on breaking news in livermore, east avenue middle school remains locked down now. police search for a possible gunman. >> we want to stress they say they've not found anything suspicious so far. the school district says students and staff there after hours are all safe and inside of a classroom. they say they will remain there until police are certain it's safe for them to leave. this started when a parent called to report seeing a man with a gun in the hallway. >> police are searching every classroom, office, closet, and hallway now. and they've found nothing at this point. agencies are searching for a possible gunman on campus. we'll let you know when police are finished the search or

a man who lost his thumb flew halfway across the country after learning about a procedure i featured here on abc 7 news. surgeons have been predict -- perfecting this over the last several years. a caution, there is video from the surgery today that some of you might kind graphic. mike stevens remembers the day his life changed. his hand contacted a fan blade. >> and within a second, the story was over. >> after losing the thumb on his left hand, life became difficult. >> it usually takes me six hours, took me probably 16. >> that is when his wife began searching the internet for options. one of the first hits was a story we reported four years ago here on abc 7.

garrett le fever had a big toe transplanted to his hand to replace a missing thumb. the surgeon told the stevens family he can do the same for mike. >> our goal is between 60 to 80% function back. >> in a complex surgery dr. lee prepared his hand and a second team removed his toe. because of the extent of the injury doctors also removed a large section of tendon along with the toe. next challenge? connecting blood vessels. >> it's vascular, you know, finding blood supply to the toe. >> and four hours into the surgery the team had his toe connected to his hand, then began connecting blood vessel autos we're doing our last blood vessel here. >> and after a recovery doctors expect the end result to look like this transplant.
